This disclaimer note is enforceable and binding on the recipient and user in terms of sections 11(1) to 11(3) of the Electronic Communications and Transactions Act, 2002 (Act No. 25 of 2002).

Email disclaimer and Confidentiality:

The Office of the Premier’s (OTP) email and any attachments, links and/or files conveyed with it may contain privileged and/or confidential data and information.

If you are not the intended recipient of the email and any attachment, links and/or files transmitted with it, you may not copy, store, distribute, print or forward it to anyone whatsoever including disclosing the email contents or using any part of the email. You should destroy the email and notify the sender immediately.

Rights to the generated contents will be reserved to the OTP except where otherwise stated by the original authors. If the contents generated by the original authors are offensive and/or malicious to the other party, that will reflect the opinions of those author(s) and not that of the OTP.

Internally hosted Internet- based systems:

The personal data and information of OTP employees, associates and of the OTP itself collected into the OTP’s internally hosted internet- based systems will not be used, disclosed, distributed or revealed to unauthorized persons except where legally compelled to do so.

The OTP’s internally hosted internet-based systems may contain privileged and/or confidential data and information. The OTP shall not be responsible for the validity, reliability, credibility, and quality of the data preserved on its systems.  External stakeholders shall be responsible for the validity, reliability, credibility and quality of their own data uploaded into the OTP’s internally hosted internet-based systems.

Copyright in the data, information and contents displayed and contained in the OTP’s internally hosted internet-based systems belongs to OTP unless stated otherwise. You may not modify, copy, distribute, transmit, display, perform, reproduce, publish, license, create unoriginal works from, transfer, or sell any information or data, software, products or services obtained from the OTP’s internally hosted internet-based systems.

You understand and acknowledge that access to the OTP’s internally hosted internet- based systems may be limited, delayed, or unavailable during system upgrades, maintenance, electronic and electrical disruptions, communication or system problems, and/or for other reason which may occur and that the OTP is not obliged to notify you of the unavailability of the systems.

You understand and agree that the OTP will not be liable or responsible if you are unable to access the OTP’s internally hosted internet- based systems. In the event that access is delayed or unavailable at any time or you experience problems accessing the systems, you agree to use alternative means available to you.

Privilege and authority to bind:

By accessing or using the OTP’s internally hosted internet- based systems and email you agree to be bound by all of the terms, conditions, and notices in this disclaimer, including any additions, changes or modifications that may be made without your knowledge. If you do not agree to all of the terms and conditions in this disclaimer, do not access the OTP’s internally hosted internet-based systems and/or email or use any of the services, contents, data, information and privilege whatsoever available on the OTP’s internally hosted internet- based systems or email.
